HMRC has won it's tenth case against a provider of avoidance schemes in the Court of Appeal. I saw an interesting article recently which queried whether, once an avoidance scheme was ruled by a Court as ineffective and tax relief denied, whether it is better described as tax evasion, food for thought certainly.
The Court of Appeal has ruled that NT Advisors’ latest scheme consists of a series of circular payments designed purely to generate tax deductions with no genuine commercial purpose. No tax relief is therefore due. The latest ruling covers 304 users and will protect £143m for the UK
